Terms & Conditions

These terms and conditions are the contract between you and Pink Wellies Nail ("us", "we", "I" etc). By visiting or using our website you agree to be bound by them.

I/we are: Laura Brewer, Pink Wellies Nails of Ross-on-Wye, Herefordshire. You are: anyone who uses our website.

 

Please read this agreement carefully.

BOOKINGS & CANCELLATIONS

  • All appointments are made via our online booking portals or through direct conversation with us.

  • If your do not receive a confirmation email, then your appointment is not secure and may be offered to someone else.

  • We do not take deposits or booking fees, but we may capture card details at the time of booking.

    • ​You can change or cancel your appointment free of charge up to 24 hours in advance of your appointment.

    • If you cancel or reschedule within 24 hours of your appointment you will be charged 50% of the total value.

    • If you fail to attend your appointment, then 100% of the total value will be charged.

  • For cancellations of orders, please see below (ORDER FULFILLMENT/SHIPPING)

CONSULTATIONS

  • You will be asked to complete a consultation form at the start of your appointment. Every client is required to do this so that we can assess whether the treatment is suitable for you.

  • Treatments will not be carried out without a consultation form being completed.

REPAIRS & REFUNDS

  • Gel polish is guaranteed chip and lift free for 48 hours after the service. If chips or lifting occurs after 48 hours, we are not held liable and repairs will be charged at £3 per nail.

  • Replacement press-on nails can be provided at a cost of £3 per nail, including postage.

  • Refunds are not issued under any circumstances. 

  • Please note, I do not infill, repair or remove another nail technician’s work.

ORDER FULFILLMENT/SHIPPING

  • Orders are fulfilled in a first come, first served process. 

  • If you wish to have an order for a specific date, please contact me and I will do my best to accommodate this.

  • Orders are posted to UK addresses using Royal Mail 2nd class. Once they have been posted, we are not responsible for when they arrive.

  • If you wish for your order to be tracked, or posted to an address outside of the UK, please contact me before placing your order to discuss this.

  • I am unable to amend orders once they have been started. Any changes to size, length or design will incur a charge of £3 per nail.

  • Orders can be cancelled for a full refund if the order has not yet been started. Once work has begun on a set of nails, no refund can be provided.

DATA PROTECTION

  • We collect data from you to provide a professional service, without this we are unable to carry out the service. 

  • We do not pass on any data to a third party.

  • We only collect data which is relevant to your treatment.

  • Consultation cards are stored securely and access is only given to relevant staff.

  • Photos are used on social media and/or our website with your consent.

  • Consultation cards are stored for 7 years. After that time, information will be destroyed and disposed of if no longer needed.

  • You have the right to access your records should you wish.

PAYMENT

  • Payment can be made via our online booking portal, charging the card you used to confirm the booking.

  • Cash or card payment is accepted at the appointment.

 USE OF SITE BY CHILDREN

  • We do not sell products or provide services for purchase by children, nor do we market to children.

  • If you are under 18, you may use our website only with consent from a parent or guardian.

  • We undertake to preserve the confidentiality of all information you provide to us and hope that you reciprocate. 

  • Our policy complies with UK law accordingly implemented, including that required by the EU General Data Protection Regulation (GDPR).

  • The law requires us to tell you about your rights and our obligations to you in regard to the processing of your personal data, we do this by requesting you read the information provided at 

  • Except as set out below, we do not share, sell or disclose to a third party, any information collected through our website.

  1. Information we process because we have a contractual obligation with you​.

    • When you create an account on our website, buy a product or service from us, or otherwise agree to our terms and conditions, a contract is formed between you and us. INFORMATION WE PROCESS BECAUSE WE HAVE A LEGAL OBLIGATION

  1. We are subject to the law like everyone else and sometimes we must process your information in order to comply with a statutory obligation. e.g.

    • We may be required to give information to legal authorities if they so request, or if they have the proper authorisation such as a search warrant or court order.​ This may include your personal information, specific uses of information provided to us on the understanding that it will be shared with a third party.

  2. Our website may allow you to post information with a view to that information being read, copied, downloaded or used by other people, e.g.

    • Posting a message on our forum​

    • Tagging an image

    • Clicking on an icon next to another visitor's message to convey your agreement, disagreement or thanks.

      • in posting personal information, it is up to you to satisfy yourself about the privacy level of every person who might use it. We do not specifically use this information, except to allow it to be displayed or shared. Once your information enters the public domain, we have no control over what any individual third party may do with it. We accept no responsibility for their actions at any time​.

COMPLAINTS REGARDING CONTENT ON OUR WEBSITE

  1. Our website is a publishing medium. Anyone may subscribe and then publish information about himself, herself or some other person. We do not moderate or control what is posted. 

  2. If you complain about any of the content on our website, we shall investigate your complaint. If we feel it is justified or if we believe the law required us to do so, we shall remove the content whilst we investigate.

    • Free speech is a fundamental right, so we have to make a judgement as to whose right will be obstructed: yours, or that of the person who posted the content that offends you. If we feel your complaint is vexatious or without any basis, we will not correspond with you about it.​

INFORMATION RELATING TO YOUR METHOD OF PAYMENT

  1. Payment information is never taken by us or transferred to us either through our website.

  2. At the point of payment, you are transferred to a secure page on the website of Fresha or some another reputable payment service provider. This page may be branded to look like a page on our website, but it is not controlled by us.
